Terms & Conditions

RGB UTC Campaign

 

This Campaign is being organized by HCCB, a company duly incorporated under the Companies Act, 1956 and having its registered office at (address) and one of its branch offices at (address) in association with its partner agency, 4 Minute Mile Marketing Service Private Limited, a company duly incorporated under The Companies Act, 1956 having its regd. office at  B-44, RUIA PARK, J.R. MHATRE MARG, JUHU, MUMBAI-400049 (‘Agency’), hereinafter together referred to as the “Organizers”.

Please read the terms and conditions of the (RCB UTC Campaign) before participating in it (hereinafter referred to as the “Campaign”).

By participating/ availing this Campaign, it is deemed that the participants i.e. retailers and other channel partners of HCCB (hereinafter collectively referred to as “Participant”) have irrevocably and unconditionally accepted all terms & conditions contained herein, including any/all amendment, modification, etc. made thereto without demur and shall throughout remain bound to them as under:

1. Agreement to Terms and Conditions

  1. By participating in this Campaign, Participants fully and unconditionally agree to abide by the Terms and Conditions available on (campaign URL) (“T & C Website”). Organizer’s decision shall be final and binding in all matters related to the Campaign subject to all requirements set forth herein.
  2. Organizer reserves the right to exclude any person from the Campaign on grounds of misconduct or criminal record.
  3. Organizer reserves the right to terminate, modify or extend the Campaign, at any time at its absolute discretion, without assigning any reason.
  1. Organizers reserve the right to use the participant details for future promotions run by HCCB.

2. Eligibility

  1. This Campaign is open only for Indian Citizens who are above 18 years of age, across select states across India. These states are Karnataka, Andhra Pradesh, Telangana, Maharashtra , Goa, Gujarat , Madhya Pradesh , Tamil Nadu, Odisha, Kerala & Jharkhand , further referred to as  (“Territory”).
  1. This campaign is only for the retailers and any other channel partners of HCCB. Consumers, Organizers’ employees, their family members, sponsors, agents, etc. are not eligible to participate in the Campaign.

3. Campaign Period

  1. The Campaign is open only between 27th January 2024 to 29th March 2024, both days inclusive (hereinafter “Campaign Period”). Thereafter, Organizer will not be obligated in any manner whatsoever.
  2. The Campaign Period stands extended as under:
    1. For all states except Tamil Nadu and Kerala, the Campaign stands extended till 26th April 2024 only for Bumper Prize.
    2. For Kerala and Tamil Nadu, the Campaign stands extended till 26th April 2024.
All other details as captured in the terms and conditions with respect to the applicable prizes remain the same.  (hereinafter “Extended Campaign Period”).
  1. Entries beyond the Campaign Period will not be considered valid for participation in the Campaign. Stock of eligible HCCB products (as detailed under) without the Campaign offer will also be available across the Territories. Further certain stock containing the Campaign offer may continue to be available even after the Campaign period. However, prospective participants understand and agree that they will not be permitted to participate in the Campaign after the expiry of the Campaign period and further agree not to raise any claim or complaint against HCCB, its affiliates or its agents in this respect.

4. How to Participate

Part- I Applicable to states identified above except Tamil Nadu

  1. This Campaign is available on sale of (Coke & Sprite 200 ml and300 ml RGB)
  2. To participate in the Campaign, Participant will be required to register on the campaign portal www.utcrgb.com
  3.  Participant will fill in the details as required, enter a unique code mentioned inside the cap of the bottle, and the area pin-code from where they are participating.
  4. Each Participant can participate in the Campaign multiple times with different codes during the Campaign Period.
  5. The decision on number/s of winner(s) is subject to the Organizer’s discretion.
  6. Winners of Weekly, bumper and Mega prizes will need to share address and documentation as mentioned under the prizes.
  1. The organizer and agency shall not be responsible for (including but not limited to):
  • any SPAM generated messages;
  • the Operator Code not being displayed on the user’s mobile phones;
  • any SMS message delivery failures;
  • any lost, late or misdirected computer transmission or network, electronic failures or any kind of any failure to receive entries owing to transmission failures or due to any technical reason;
  • If the participant has registered himself to the DND of the telecom provider/ the participant has registered with National Do Not Call Registry/ Participant has specifically requested for not receiving messages for the specific campaign
  • Other conditions beyond its reasonable control.

5. Prizes

1. Digital Money  Vouchers:

Part- I Applicable to states identified above except Tamil Nadu

During the Campaign Period, all eligible Participants across the Territory shall stand a chance to win, Digital Money Cashback of Rs. 10 (a total of 36,60,768 cashbacks to be won). No claim whatsoever shall lie against the Organizer in case any particular Participant does not receive the cashback due to any operational issues related to his/her digital payment account or due to any reasons.

Note: A Participant can participate multiple times with different unique codes during the Campaign Period. Not withstanding anything contained elsewhere. A maximum of 240 Codes can be used per mobile number /UPI ID/Bank Account Number during the Promotion Period for winning cashbacks. A maximum of 5 codes can be used per mobile number / UPI Id / Bank Account number during the day for winning cashbacks. This limit may be changed at discretion of the company. The promo will run for 24 hours each day during the campaign period and each hour will have a limited number of cashbacks winners. The number of cashbacks to be won for that hour will be reflected on the microsite. For redeeming cashback UPI registration is mandatory and winner has to provide valid UPI ID. Failure to comply with this will lead to forfeiture of the opportunity to get the cashback amount transferred to the user’s account / wallet.

Part- II Applicable to Tamil Nadu

We would run a slogan contest for Tamil Nadu. All participants are required to share a slogan on to be eligible for the Campaign.

Rest process remains same as identified above in 5.1.

2. Weekly Prizes:

Part- I Applicable to states identified above except Tamil Nadu

During the Campaign Period, a total of 189 lucky winners from the pool of eligible Participants shall win Physical Prizes comprising of Phone.  A participant shall be eligible to win a phone only once during the Campaign Period. The winners of the Physical Prizes shall be selected by way of a randomizer software, in the presence of an independent auditor and announced on a weekly basis during the Campaign Period. The said Prize(s) shall be distributed by way of Courier/ Registered Post within 45 days from the date of announcement, as per their availability and subject to satisfying conditions mentioned in the T&C. Winners will be contacted and asked to share their address for the delivery of the prize. The Winners shall not be entitled to seek any replacement / exchange against the Prize(s) that they receive. Goods once delivered cannot be replaced under any circumstances.

Part- II Applicable to Tamil Nadu

From the participants the best slogans every week will be eligible to receive mobile phones. 

During the Campaign Period, a total of _______27 winners______ will win the mobile phone basis the best slogan criteria. A participant shall be eligible to win a phone only once during the Campaign Period. The said mobile phone shall be distributed by way of Courier/ Registered Post within 45 days from the date of announcement, as per their availability and subject to satisfying conditions mentioned in the T&C. Winner receiving the mobile phone will be contacted and asked to share their address for the delivery of the prize. The winner shall not be entitled to seek any replacement / exchange against the mobile phone that they receive. Goods once delivered cannot be replaced under any circumstances.

3. Mega Prize:

Part- I Applicable to states identified above except Tamil Nadu

At the end of the Campaign Period, a total of 6  lucky winners from the pool of eligible participants, shall win a Royal Enfield Classic 350 EFI (ex- showroom price). The winners of the Mega Prize shall be selected by way of a randomizer software, in the presence of an independent auditor, and announced within 60 days from the end date of the Campaign Period.

  1. The Mega Prize would include the ex-showroom price of the motorcycle.
  2. All taxes, Insurance & RTO charges etc will need to be borne by the winner.
  3. Gift tax will be borne by the winner.
  4. Winner will need to pay gift tax to 4 Minute Mile Marketing Pvt Ltd by bank transfer or Demand draft before the motor bike is booked in their name. 4MM will submit the gift tax on behalf of the winner and share the certificate of the same.
  5. The winner(s) will be required to submit all necessary documents viz. PAN Card, 2 Address Proofs (Aadhar Card, Telephone or Electricity Bill) and ID Proof (Aadhar Card, Driver’s License) within 7 days from being declared as the Winner.
  6. The Prizes shall then be distributed as per the instructions of the Organizers.
  7. The prize is for the winner solely and is not transferrable and cannot be sold under any circumstances.
  8. The Winner of the Mega Prize will not be given an option to choose any other prize in place of the Motorcycle.
  1. Goods once delivered cannot be replaced under any circumstances.

4. Bumper Prize:

Part- I Applicable to states identified above except Tamil Nadu

At the end of the Campaign Period, maximum of 15  lucky winners from the pool of eligible participants except the winners of the Weekly or Mega prize, shall win Gold vouchers of Rs. 5,00,000 each.

a. Winner Selection

  1. Winners of the Bumper prize will not be eligible to win the Mega prize or Weekly prize.
  2. The Winners of the Bumper Prize will not be given an option to choose cash in place of the gold voucher
  3. The Bumper prize is for the winners solely and is not transferrable and cannot be sold under any circumstances.
  4. No request for a change in brand or specifications etc. will be entertained.
  5. The prize amount is inclusive of taxes and delivery costs.
  1. Gift tax will be borne by the winner.

Part- II Applicable to Tamil Nadu for Mega Prize and Bumper Prize

At the end of the Campaign Period, the slogan of the participants winning the mobile phone will be judged and out of those participants, top slogans (maximum of 3) winners subject to criteria specified below, shall win Gold vouchers of Rs. 5,00,000 each (Bumper Prize) and the next best slogan shall win a Royal Enfield Classic 350 EFI (Mega prize). 

a. Winner Selection for Mega Prize

The winners of the Mega Prize shall be selected by an independent auditor, and announced within 60 days from the end date of the Campaign Period.

  1. The Mega Prize would include the ex-showroom price of the motorcycle.
  2. All taxes, Insurance & RTO charges etc will need to be borne by the winner.
  3. Gift tax will be borne by the winner.
  4. Winner will need to pay gift tax to 4 Minute Mile Marketing Pvt Ltd by bank transfer or Demand draft before the motor bike is booked in their name. 4MM will submit the gift tax on behalf of the winner and share the certificate of the same.

  1. For Participants from Tamil Nadu – The winner will be selected at the end of the program period via third party auditor basis the uniqueness and creativity of the answers submitted by the participants through the promotion platform

b. Winner Selection for Bumper Prize

  1. The Winners of the Bumper Prize will not be given an option to choose cash in place of the gold voucher
  2. The Bumper prize is for the winners solely and is not transferrable and cannot be sold under any circumstances.
  3. No request for a change in brand or specifications etc. will be entertained.
  4. The prize amount is inclusive of taxes and delivery costs.
  5. Gift tax will be borne by the winner.
  1. For Participants from Tamil Nadu – maximum of 3 winners will be selected at the end of the program period via third party auditor basis the uniqueness and creativity of the answers submitted by the participants through the promotion platform

 5. Contacting Winners:

  1. With respect to the States except for Tamil Nadu, once the Winners are selected via system randomizer, Winners will receive a congratulations SMS. SMS will include a link & a winning code. For Tamil Nadu, the Winners selected via independent auditor, Winners will receive a congratulations SMS. SMS will include a link & a winning code.
  2. 2 round of SMS broadcasts and 1 round of round of calls will be made to those shortlisted winners who are yet to share their details as per process defined in “How To Participate”.
  3. In case the winners fail to provide documents within the stipulated timeframe, the organisers reserve the right to choose alternative winners in their place.
  1. This decision will be final and binding.

6. Intellectual Property

  1. All rights, title and interest, including but not limited to the Intellectual Property Rights, in the Campaign material(s) and in any and all responses received shall vest solely and exclusively with HCCB at all times. HCCB or any person or entity permitted by HCCB in this regard shall be entitled to use the responses received or any information in connection with the entry in any media for future Campaign, marketing, publicity and any other purpose, without any permission and or payment to the Participant.
  1. All material submitted in connection with the Campaign (whether written, audio, electronic or visual form, or a combination of those) or any photographs, video and/or film footage and/or audio recording taken of Participants are assigned to HCCB upon submission and become the property of HCCB exclusively. HCCB may use the material in any medium in any reasonable manner it sees fit. Copyright in any such material remains the sole property of HCCB.

7. General Conditions

  1. All Winners shall be informed on their respective registered mobile numbers about them being the winners of corresponding prizes, and the prizes shall be delivered to winners as per the instructions of the Organizers and in accordance with the T&C of the campaign.
  2. The Participant understands and agrees that the selected winner(s) alone shall be entitled to prizes, subject to all terms and conditions mentioned herein, and furnishing of correct and complete details (including but not limited to) in the prescribed manner and to the entire satisfaction of the Organizer.
  3. The Participants may receive call(s) from the Agency for verification of their details ahead of announcement of winners. This shall, however, in no manner be construed as a communication for being a Winner of the Campaign.
  4. The Campaign will be promoted at the sole discretion of the Organizer.
  5. Organizer and agency will announce the selected Winner/s as per the terms set out in the T&C. The Winners will be intimated on the registered mobile number through which they they had participated in the Campaign. The decision of the Organizer in this regard shall be final & binding upon the Participant and/or the Winner(s), and the Participant/ Winner(s) hereby agree that no claims, disputes, etc. of any sort shall be raised against the Organizer.
  6. Three attempts will be made to contact the Winner on the registered mobile number provided to, and available with the Organizer and agency. Thereafter, the Organizer and partnering agency, at its discretion, will choose the next winner without any further attempt to approach or contact the earlier selected winner.
  7. The prize can neither be exchanged nor redeemed for cash/ any non-monetary consideration nor it is transferable.
  8. The Winner will be required to collect their prize after completion of all formalities (submission of signed copy of ID proof, Address proof and PAN Card - addresses of Aadhar card and Address proof should be the same) to the entire satisfaction of the Organizer within 15 days. In case of the Bumper prizes, the winners will need to visit the nearest (Royal Enfield) dealership to collect their respective prize and fulfill the requisite formalities and documentation as requested by the dealership(s). In case the Winner(s)/ Participant does not collect its prize within the stipulated time period stated hereinabove, then the validity of the prize shall lapse automatically without any further notice to the Winner(s)/ Participant in this regard.
  9. The prize/s is subject to the applicable laws of India. Any deduction of applicable taxes, levies and other statutory payments, including but not limited to applicable gift tax, shall be borne solely by the Winner. The prize would be delivered/ handed over to the Winner only upon proper identification and verification of the Participant to the full satisfaction of the Organizer. The Winner shall be duly required to provide a copy of their PAN card and provide satisfactory proof of payment of all applicable taxes and levies. Payments of all applicable taxes by the Winner shall be a condition precedent before the prize is finally provided to the Winner.
  10. HCCB or its partner agency shall at no time be required to verify the accuracy and/or correctness of the information so provided by the participants. Further, you are responsible for maintaining the confidentiality of your personal details and records including e-mail accounts and passwords.
  11. HCCB or it’s partner agency accepts no responsibility for any tax implications that may arise from the prize winnings. Unless otherwise specified, Tax is to be borne by the winner. Winners will have to bear incidental costs if any, that may arise for redemption of the Prizes.
  12. While accepting the prize under the Campaign, the Winner(s) may be required to execute an “indemnity and release of claims” form as may be provided by Organizer, as the case may be, which shall release the Organizer of all liability, loss, damage, demand, claim, etc. in connection with the Campaign and prizes contemplated under this Campaign. Failure to complete and sign any documents requested by Organizer may result in disqualification of such Participant and/or Winner. Thereafter, the Organizer, at its discretion, will be entitled to choose the next winner. All decisions of Organizer shall be final in this regard.
  13. Organizer and agency is not responsible for any errors or omissions in the terms and conditions contained herein. All information provided in the Campaign is provided on "as-it-is" basis without any warranty of any kind. Organizer, its management, directors, employees, officers, affiliates or subsidiaries, agents, representatives, etc. or any of its sponsors/ partners make no representations, and further disclaim themselves from all express, implied, and statutory warranties of any kind towards the Participants, Winners and/or any third party with respect to accuracy, timelines, completeness, merchantability, or fitness of the Campaign.
  14. Organizer shall provide the prize on "as-it-is” basis without any warranty or guarantee (whether express or implied) regarding the prize covering its quality, suitability, merchantability or its fitness. The Organizer, its management, directors, employees, officers, affiliates or subsidiaries, agents, representatives, etc. disclaims itself from all liabilities, including but not limited to, those arising due to any deficiency/ defect in the Campaign and/or prize and for any consequential damages/ losses arising with respect to the Campaign and/or the prize.
  15. Organizer and agency reserve its right to select and declare or not to declare the prize Winner if the number of entries submitted for the Campaign is not up to the logistical satisfaction of Organizer. Decision of Organizer and agency in this regard shall be final & binding, and no correspondence in this regard shall be entertained.
  16. All rights, title and interest, including but not limited to Intellectual Property Rights in the Campaign and/or any other promotional material(s) shall vest solely and exclusively with Organizer at all times. In connection with the Campaign, the Organizer or any person or entity permitted by the Organizer shall be entitled to use personal details of Participant and/or Winners such as names, characters, photographs, voices, videotape, etc. for any media promotions, marketing activity, publicity and likewise purposes. By voluntarily participating in the Campaign, Participant and/or Winner(s) hereby waive off all their rights to claim royalty, remuneration or legally challenge due to any such use of their personal details by the Organizer.
  17. Organizer and agency reserve its right to change, defer, alter or cancel this Campaign in part or full, or change any or all terms and conditions of the Campaign, without giving any prior intimation/ notice of any kind. Further, it shall not be liable for any consequential losses/ damages to any Participant and/or Winners in this regard. Decision of the Organizer in general, and with respect to this Campaign shall be full, final, binding and non-contestable upon the Participant and/or the Winners.
  18. Nothing contained herein amounts to a commitment or representation by the Organizer to conduct further likewise Campaign or schemes.
  19. Under no circumstance the Organizer and agency, its management, directors, employees, officers, affiliates or subsidiaries, agents, representatives, etc. shall be liable to the Participant, Winners and/or any third party for any loss of profits or lost opportunity, or for any indirect, special, consequential, incidental, or punitive damages whatsoever, even if Organizer has been advised of the possibility of any such damages. The Participant/ Winners specifically agree not to file and/or initiate in person or through any family member or through any third party, any criminal and/or civil proceedings/ complaints/ applications in any courts or forum in India against Organizer, its management, directors, employees, officers, affiliates or subsidiaries, agents, representatives, etc. to claim any damages for any losses or seek relief in connection with the Campaign and/or the prizes. The Participant/ Winners specifically agree that Organizer, its affiliates, its group companies, their employees, officers, directors or any other person and/or sponsors shall not be responsible for any claims/ liabilities/ losses (including legal fees) arising out of and in relation to any injury/ damage/ harm/ loss/ death/ mental or emotional trauma suffered by the Participant or prize Winners in any manner whatsoever in connection with the Campaign and/or the prizes.
  20. HCCB reserves the right to substitute the Prize offered at any point of time. Such rewards will be of equal or greater value.
  21. All the costs and expenses for collecting the prize will be borne solely by the winner and HCCB or its partner agency shall not entertain any claim, whatsoever. The winner is solely responsible for any other expenses related to the acceptance and use of the offer.
  22. Organizers shall not be liable to perform any of its obligations under the Campaign or in respect of the Prize(s) where it is unable to do so as a result of unforeseen circumstances, Force Majeure conditions such as epidemic outbreak, pandemic including but not limited to COVID, lockdown or circumstances beyond its reasonable control. The Winners hereby acknowledge that delivery of the Prize(s) may get delayed owing to lockdown restrictions in their respective area/state and/or that of the Organizers’ place of business, however the Organizers shall, on a best endeavor basis, resume the prize distribution process once said lockdown restrictions are lifted.
  23. Organizer and agency is empowered to take a decision in case of any conditions, circumstances and scenarios beyond these terms and conditions of the Campaign.
  24. The Campaign and the terms and conditions herein shall be governed by and construed in accordance with the applicable laws in India. All matters with respect to the Campaign and/or prizes are subject to the exclusive jurisdiction of the courts at Mumbai only. The Campaign shall be deemed void where prohibited by law.
  25. In case of any queries with respect to the Campaign, please write to helpdesk@4mm.co.in. No queries, claims, dispute, complaints, or grievances shall be entertained by Hindustan Coca-Cola Beverages Private Limited and its agency after 60 days from the date of the closure of the contest.
  26. The contest shall run on Contest products. Packs without the offer are also available in the market.
  27. The image of the prize depicted on the press ads/posters/TVC's/pack shots etc. are for illustrative purposes only and the actual prize may vary from the depiction made.
  1. The Contest is subject to the guidelines/directions issued by the Telecom Regulatory Authority of India, Department of Telecommunications, and any governmental or statutory authority as may be applicable from time to time.
